Model non-exclusive artwork use agreement — Romania / EU
Complete this model for the particular competition edition. It is not an executed agreement and must not be signed with incomplete fields or choices. The English text translates the Romanian model; it is not a universal contract for every country.
1. Parties and artwork
- Author / economic rights holder: name __________________; email / correspondence address __________________.
- Organiser: legal name and form __________________; registered address __________________; tax / registration details __________________; representative and capacity __________________; contact __________________.
- Competition edition and applicable rules: __________________; version dated __________________.
- Artwork: title __________________; filename / identifier __________________; description __________________. Identify all joint authors and obtain every rights holder's agreement for team entries.
2. Nature of the agreement and retained rights
The author grants only the economic rights expressly specified below, on a non-exclusive basis. The author remains free to use the work and authorise others. Moral rights, including authorship and integrity, are not assigned or waived.
Online publication, an award or delivery of a file does not automatically place a work in the “public domain”. This agreement does not transfer rights in all the author's future creations.
3. Uses for running and presenting the competition
For the identified work, the author authorises the organiser to:
- reproduce it in working files, jury copies, catalogues, educational materials and competition presentations;
- distribute copies of these materials to the public;
- display it at competition exhibitions;
- communicate it to the public and make it available on the competition website and communication channels, accessible at a time and place chosen by users;
- make only necessary technical adaptations: resizing, format conversion and page layout, without distorting the work. Other artistic changes require separate agreement.
Territory: worldwide, including because of internet access. Term: three years from signature unless the parties expressly agree another period before signing: __________________. New public uses cease at expiry; copies retained solely for legal obligations or legal claims are not reused publicly without another basis.
Remuneration for these uses: a non-exclusive authorisation granted free of charge, expressly accepted by signature. Any prize is separate and governed by the rules. Mandatory remuneration, information and other statutory protections remain unaffected where applicable.
4. Reuse by the public — a separate choice
Select one option. Without an express choice, this section does not authorise third-party reuse:
- ☐ NO: I do not authorise the grant of reuse rights to third parties under this agreement.
- ☐ YES: I expressly authorise the organiser to grant third parties free, non-exclusive permissions to reproduce, distribute, display, communicate and make the identified work available for cultural, educational, tourism and place-promotion purposes, including on products and packaging offered for sale. Only the technical adaptations in section 3 are permitted. Territory is worldwide; duration is the remaining statutory protection period, subject to applicable mandatory law.
For YES, each reuser receives written conditions: credit the author and competition, preserve integrity, maintain non-exclusivity, do not imply the author's personal product endorsement, and do not claim exclusive rights in the work. Exclusive trademark use or artistic alteration is not authorised by this model. The organiser records permissions and can provide information to the author as required by law. Third parties receive no rights to the author's contact data.
This choice is not a copyright waiver. For a standard public licence, the parties must separately select its text and version after checking compatibility with this agreement. Declining does not prevent entry, but the work will not be offered for public reuse under this option.
5. Attribution and obligations
- Chosen attribution name / pseudonym: __________________. The organiser credits the author as appropriate to the use and law, without publishing form addresses, emails, telephone numbers or signatures.
- To the best of their knowledge, the author holds the granted rights and identifies third-party elements and licences: __________________. AI tools and human contributions: __________________. The author does not guarantee exclusive rights in elements for which the law recognises none.
- The organiser stays within the permission. Rights complaints are examined, seeking the author's explanation and suspending disputed use where justified. Each party's liability follows applicable law; there is no blanket exclusion for its own fault.
6. Minors
For authors under 14, the legal representative signs on their behalf. Authors aged 14–17 sign with parental / guardian approval, subject to statutory exceptions concerning legal capacity. Any further legally required authorisations must be obtained before rights are granted; a checkbox does not replace them. Broad reuse permission must be considered separately in the child's interests.
7. Personal data and disputes
Identification and agreement-administration data are processed under the privacy information supplied before signature. Signing does not consent to marketing or photography.
Romanian law applies without excluding applicable mandatory rules or data subject rights. Parties first seek an amicable solution; otherwise they may approach courts competent under law. Access to competent authorities is not restricted.
8. Signatures
- Author / rights holder: name __________________; signature __________________; date __________________.
- Legal representative, if applicable: name __________________; capacity __________________; signature __________________; date __________________.
- Organiser: representative __________________; capacity __________________; signature __________________; date __________________.
- The section 4 choice and any different term are completed before signature. Each party receives a copy.
